Gearia Terms of Service

Effective date: 【Month DD, 2026】

Welcome to Gearia. These Terms of Service ("Terms") are a contract between you and 【Operator legal name】 ("Gearia", "we", "us"). They apply to your use of Gearia's website, apps and related services (the "Services"). Our Privacy Policy explains how we handle your personal information and forms part of these Terms.

Please read Section 4 ("Building and safety") and Section 12 ("Disclaimers, limitation of liability and indemnity") carefully. Gearia's plans and calculations are for reference only and do not replace design and inspection by qualified professionals.

Nothing in these Terms limits rights you have as a consumer that cannot be waived by contract.

1. Who we are

Gearia is operated by 【Operator legal name】, whose registered address is 【Address】. You describe something you want to build. Gearia uses AI to break the request down and gives you several plans: a parts list with shopping references, build steps, a 3D preview model, a force analysis, and engineering checks calculated by software from standard formulas.

2. Account creation and access

Minimum age. You must be at least 【18】 years old, or the age of majority where you live if that is higher, to create an account and use Gearia.

Registration. You must give accurate information and keep it up to date. Gearia does not use passwords: you sign in with an email code or with your Apple or Google account.

Account security. Keep your email and sign-in accounts secure. You are responsible for all activity under your account. Contact us right away if someone else is using it.

One person per account. A personal account is for you alone and may not be transferred, lent or shared. Team plans are used by seat, assigned by the team admin.

Organizations. If you accept these Terms on behalf of a company, school or other organization, you confirm you are authorized to do so.

3. Use of our Services

What you can do. Subject to these Terms and the law, you may use Gearia to design and plan things you want to make, download the generated files, and use the plans for personal or commercial purposes.

What you cannot do. You may not:

request or make firearms, firearm parts, silencers, ammunition, explosives, or any weapon or device designed to injure people or evade regulation. We do not provide these plans in any region or for any purpose;
make items that are illegal to make or possess where you are, or things clearly intended to endanger others;
get around our safety filters by splitting words, rephrasing, asking in steps, or disguising the purpose;
upload models, drawings or photos you have no right to use, or otherwise infringe anyone's intellectual property, privacy or other rights;
scrape the Services, call them in bulk with automated tools, resell or rent them, or reverse engineer or decompile them (except where the law expressly allows);
use outputs to build a product that competes with Gearia, or to train AI models;
interfere with the Services, attack our systems, get around usage limits, or impersonate others;
present AI-generated content as a design, test report or certification issued by a professional engineer.

4. Building and safety

Reference only. Strength, life and safe-range figures are calculated by software from published engineering formulas and typical material properties, but most of the dimensions and assumptions they use are filled in by AI. The calculations do not account for the actual batch of material you get, machining and welding quality, assembly error, corrosion and wear, temperature changes, or how you actually use the item.

Not a professional service. Gearia is not an engineering, testing or certification body. Its results do not replace the judgment of professionals such as licensed engineers, licensed electricians or pressure-vessel inspectors. 3D models are previews, not manufacturing drawings.

Your responsibility. You decide, and are responsible for, whether and how to build, test and use anything. Before you start, you should:

check the dimensions, parts and calculations in the plan and satisfy yourself that it is safe;
have a qualified professional review anything involving loads, lifting, hydraulics or pneumatics, high temperatures, mains electricity, fuel, high-speed rotation, carrying people, or road use;
follow local laws and building and electrical codes, and obtain any required permits and inspections;
use the protective measures in the plan, such as safety glasses, guards and standing to the side; start with a small load the first time and increase gradually;
never use anything dangerous on other people, and keep it away from children.

High-risk plans. For plans the software rates "high risk", you must confirm you have read the safety notice before the steps are shown. After confirming, you still need to judge for yourself whether it is safe.

5. Inputs, outputs and files

Your inputs. The text you enter and the photos, drawings and models you upload ("Inputs") belong to you or their original owners. You confirm you have the right to upload them and that they do not breach these Terms.

Outputs. To the extent we have rights in the plans, parts lists, calculations, 3D models and files Gearia generates from your Inputs ("Outputs"), we assign them to you. You may use Outputs for any lawful purpose, including commercial use, subject to these Terms.

Similar outputs. Others may make similar requests and receive similar or identical Outputs. Outputs not generated specifically for you are not exclusively yours.

Accuracy. AI makes mistakes, including wrong dimensions, wrong methods and missed risks, and part prices, links and stock change all the time. Outputs may be wrong, incomplete or out of date even when they look precise. Check them yourself before relying on them.

How we use them. To provide the Services we store and process your Inputs and Outputs and send them to the AI provider that serves us (see the Privacy Policy). We do not use your content to train AI models. Only if you turn on "Use my data to improve the product" do we use de-identified data to improve the software.

Share links. If you create a share link, anyone with the link can see that conversation. You can turn the link off at any time.

6. Feedback

We may freely use any comments and suggestions you give us, including thumbs up, thumbs down and any notes with them, without paying you or crediting you.

7. Credits, fees and payment

Credits. Gearia's AI features are paid for with credits. Credits can only be used within Gearia. They are not money and cannot be exchanged for cash, transferred to anyone else, or combined between accounts, except where the law requires otherwise. Credits can have one decimal place (for example 4.8 credits); your balance and every charge and refund are exact to 0.1 credit.

Credit packs and prices. You can buy credit packs as one-time purchases: 60 credits for US$9.99, 180 credits for US$24.99, and 900 credits for US$99.99 (as shown on the purchase page). Prices on the website are in US dollars and exclude taxes, which are added based on where you live. When you buy through the App Store in our iOS app, the price and taxes shown by the App Store apply. Credit packs do not renew automatically.

Free and reward credits. New accounts receive 【20】 credits. When you build a project and submit a report with a photo and measured results, you can earn a one-time reward of 【3】 credits per project. Free and reward credits expire 【12 months】 after you receive them; any unused balance then lapses.

Paid credits do not expire. Credits you buy have no expiry date and remain usable for as long as your account exists. Free and reward credits that expire soonest are used before paid credits.

How credits are used.

Outlines are free. When you describe what you want to build, the AI gives you an outline of three options at no charge. Each account can get up to 【20】 free outlines per day.
Each option has its own price, shown before any charge. Each of the three options has a price based on the AI's estimate of its size (number of build steps, number of parts, and whether it includes electronics and firmware), together with the revisions, questions, help requests and firmware runs it includes. You choose which option to get in detail, and credits are only taken after you confirm the price shown. If the price changes before you confirm, we show you the new price first instead of charging it.
Refund of the difference. Once the detailed plan is written, if its actual size (steps and parts) corresponds to a lower price than you paid, we automatically refund the difference to your account, and the included allowances follow the actual size. If it turns out larger than estimated, we never charge more.
Included uses and per-use charges. After you buy an option, its included revisions, questions, stuck-while-building help requests (photos allowed) and wiring diagrams / microcontroller programs are free for the project's 【180 days】. When one of these runs out, or when you use them on an option you have not bought, each use is charged separately at the price shown before use (currently 【0.1】 credits per revision, 【0.1】 per question, 【0.8】 per help request with a photo, 【0.2】 per text-only help request and 【3.8】 per wiring diagram and program). You can regenerate the detailed plan of an option you bought 【2】 times at no charge.
A precise calculation outside a project uses 【1】 credit; a question outside a project is charged at the per-question price.
Requests blocked by our safety filters, and requests that fail because of a fault on our side or the AI provider's, do not use credits (any credits taken are returned in full automatically).

Payment. Payments on the website are processed by Stripe; payments in the iOS app are processed by Apple. Credits are added to your account as soon as payment succeeds.

Refunds. Credits you buy are non-refundable, except where the law requires otherwise. If we refund a purchase (including a refund approved by Apple for an App Store purchase), the unused credits from that purchase are removed. 【Consumers in the EU and UK: at purchase you ask us to deliver the credits and start supplying digital content immediately, and you acknowledge that you lose your 14-day right of withdrawal for credits you have used. Within 14 days of purchase you may ask for a refund of unused credits, which we refund in proportion to the unused amount.】

Account termination. If you delete your account, or we terminate it because you breached these Terms, any remaining credits lapse and are not refunded, except where the law requires otherwise.

Price changes. We may change credit pack prices, how options are priced, per-use prices and included allowances. Price changes do not affect credits you have already bought or options you have already bought. We give at least 30 days' notice of changes to how credits are used. The price shown before each charge is the one that applies.

8. Third-party services and links

The Services include third-party services and links, such as shopping links, Apple and Google sign-in, Stripe payments and our AI provider. They are governed by their own terms and privacy policies, which we do not control. Products behind shopping links are sold by third parties, who are responsible for their quality, price, delivery and support.

9. Content moderation

For safety and legal compliance, we use automated and human review of requests and outputs, and may refuse or remove content that breaches these Terms. Requests blocked by our safety filters do not use credits.

10. Ownership of the Services

The Services, including the software, calculation code, interface design, trademarks and logos, belong to us or our licensors. Apart from the rights these Terms expressly give you, we grant you no other rights.

11. Suspension, termination and discontinuation

You can leave at any time. You can stop using the Services and delete your account in Settings at any time.

We may suspend or terminate. We may suspend or terminate your account if you breach these Terms, if the law requires it, or if your use could harm others, us or the Services. If we terminate for breach, fees paid are not refunded. If we terminate a paid account for any other reason, we refund the unused portion.

Appeals. If you think we made a mistake, you can appeal by emailing 【support@yourdomain】.

Inactive free accounts. We may close a free account that has not been signed into for 【12 months】, after giving notice.

Discontinuation. We may add, change, pause or stop features. If we discontinue the Services as a whole, we will give at least 【30 days'】 notice so you can export your data, and refund any prepaid, unused fees. Features marked "Preview" may be unstable.

Sections that by their nature should survive termination, such as Sections 4, 5, 10, 12, 13 and 14, survive.

12. Disclaimers, limitation of liability and indemnity

DISCLAIMER OF WARRANTIES. TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND OUTPUTS ARE PROVIDED "AS IS" AND "AS AVAILABLE". WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, INCLUDING OF ACCURACY, RELIABILITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, AND WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE.

LIMITATION OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY LAW:

WE ARE NOT LIABLE FOR PERSONAL INJURY, PROPERTY DAMAGE OR OTHER LOSS ARISING FROM ANYTHING YOU BUILD, TEST OR USE BASED ON A GEARIA PLAN;
WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, EVEN IF WE WERE TOLD THEY WERE POSSIBLE;
OUR TOTAL LIABILITY TO YOU WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE LIABILITY, OR 【US$100】.

Exceptions. This section does not limit or exclude our liability for fraud, wilful misconduct or gross negligence, for death or personal injury caused by our negligence, or for any liability that cannot be limited or excluded by law. Some jurisdictions do not allow these exclusions or limits, in which case local law applies.

Indemnity. If your breach of these Terms or the law, or your deliberate misuse of the Services, leads a third party to bring a claim against us, you will compensate us for the resulting losses and reasonable costs, including reasonable legal fees. We will notify you promptly and you may take part in the defence. This paragraph does not apply where the law does not allow consumers to be bound by such an obligation.

13. Disputes

Talk to us first. If a dispute arises, please email 【legal@yourdomain】 with your name, contact details and the issue. We will both try in good faith to resolve it within 【60 days】.

Governing law and courts. These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there. If we cannot resolve a dispute, the courts of 【Toronto】, Ontario have jurisdiction, and either party may bring a claim in small claims court where it qualifies.

Consumer rights. If you are a consumer, you keep the mandatory protections of the law where you live and may bring proceedings in the courts where you live. We do not require consumers to arbitrate or to waive the right to take part in a class action. EU consumers may also use the EU's online dispute resolution platform.

14. General terms

Changes to these Terms. We may change these Terms. We will give at least 30 days' notice by email or in the app of material changes that are adverse to you; other changes take effect when posted. If you keep using the Services after a change takes effect, you accept it. If you do not agree, you can stop using the Services and delete your account before it takes effect.

Assignment. You may not transfer your rights or obligations under these Terms without our consent. We may transfer them in a merger, acquisition or sale of assets, and will notify you.

Trade controls. You may not use the Services in a country or region subject to Canadian, US or UN sanctions, or on behalf of a sanctioned person.

Service regions. The Services (the international edition of Gearia) are not offered in mainland China; users there should use the separately provided Gearia China edition. AI features in the Services are provided by third-party model providers that do not support use in mainland China. You may not use the Services from mainland China, or use proxies, VPNs or similar means to get around our regional restrictions. We may restrict or suspend accounts used from unsupported regions.

Force majeure. We are not liable for delay or failure caused by events beyond our reasonable control, such as natural disasters, network or power failures, third-party outages or government action.

Severability. If any provision is found invalid or unenforceable, the rest remain in effect.

No waiver. Our failure or delay in enforcing a right is not a waiver of that right.

Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and us about the Services.

Notices. We will notify you by your account email or in the app. You can reach us as described in Section 16.

Language. These Terms are available in English and Chinese. If they conflict, the 【English】 version prevails, unless the law requires otherwise.

15. Copyright complaints

If you believe content on the Services infringes your copyright, email 【copyright@yourdomain】 with your contact details, the work infringed, where the infringing content is, and a statement that you are entitled to complain. We handle notices under Canada's Copyright Act and may terminate the accounts of repeat infringers.
